Learned counsel appearing for the petitioner, on instructions, submits that the petitioner will file an appropriate application seeking permission to sell out the properties before the Special Court on obtaining possession petitioner will sale the properties and deposit sale proceeds before the Special Court. On instructions, she seeks permission to withdraw the Petition. Leave granted. Petition is dismissed as withdrawn.

Needless to observe that if there is a provision for filing an appropriate application seeking permission for selling the properties of the petitioner, it is always open for him to approach the Special Court. We do not express any opinion about the same. ( V. G. BISHT ) (S. S. SHINDE) Rekha Patil
