. The applicant is accused in Special Case (POCSO) No. 6 of 2019, pending before the Additional Sessions Judge, Palghar. On 11.01.2019, victim (17 years and 9 months old) reported, that she was subjected to penetrative sexual assault by the applicant. Her statement under Section 164, reports the same facts. It appears, the victim was subjected to repeated sexual assault and therefore, the offence under Section 376 (1)(2)(n) of IPC and Section 4 of the Protection of Children from Sexual Offences Act, 2012 has been registered. The medical evidence suggest, victim was subjected to sexual assault and she delivered a female child. 1/2

2. Thus in light of the evidence, application is rejected. However, in view of victims' age the learned Trial Court is requested to conclude the trial preferably before 31st May, 2020.

3. The application is disposed of in the aforesaid terms.

4. The learned counsel for the applicant seeks liberty to renew request for enlargement on bail, in case the trial is not concluded before 31st May, 2020. Liberty as prayed is granted. (SANDEEP K. SHINDE, J.) 2/2
