IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION CIVIL APPLICATION NO. 589 OF 2015 IN SECOND APPEAL NO. 119 OF 1992 Mahadeo Anant Rane ... Applicant v/s Balkrishna Dhondu Rane & ors.
... Respondents Mr.Kunal Bhanage for the applicant.
None present for the respondents.
Coram: N.M. Jamdar, J.
Dated: 29 July, 2016 P.C.:
By this civil application, the Applicant has sought to condone the delay of 151 days in filing the present civil application and has prayed that the order of dismissal of the Second Appeal No.119 of 1992, dated 11 June 2014, be set aside.
The appeal has been dismissed for want of prosecution. The reason given in the application as to why the matter went unattended is entirely unsatisfactory, as this Court now provides various facilities to advocates and litigants to be aware of the proceedings and there is
bsb 2 58.CAS589.15.doc absolutely no reason why the matter could not be attended. The advocate has tendered an unconditional apology. Considering the apology, subject to condition that if the appeal is restored, no request for an adjournment or keeping back the matter, will be sought, the civil application is allowed in terms of prayer clauses (a) and (b). Place the appeal on board for final hearing as per its turn. (N. M. Jamdar, J.)
