At the outset, learned APP for the State makes a statement that the Petitioner's appeal is rejected by the appellate authority. Learned APP for the State handed over a copy of the said order to learned Counsel appearing for the Petitioner.

In view of the above position, learned counsel for the Petitioner seeks leave to withdraw the writ petition with liberty to file fresh one challenging the order passed by the appellate authority. Leave with liberty as prayed for is granted. Petition is allowed to be withdrawn and is dismissed as such.
