1] Heard the learned counsel for the applicants and the learned APP for the State. Perused the record of investigation. 2] By Orders dated 25.10.2018 and 29.8.2019, the the respective applicants were granted interim relief and were directed to attend the Investigating Officer on stipulated dates, to join the process of investigation.

aba.2190-2018.doc The learned APP on instructions submitted that, in pursuance of above Order, the applicants attended the Investigating Officer and have cooperated in the process of investigation. 3] The record indicates that, co-accused namely Rakesh Gupta who has been attributed with same and/or similar role in the present crime has been granted pre-arrest bail by this Court by its Order dated 6th August 2018. Perusal of the record would indicate that, the applicants herein have played little lesser role than Rakesh Gupta in the prersent crime. The applicants are therefore entitled to be protected by pre-arrest bail on the ground of parity.

4] In view thereof, interim relief granted by Orders dated 25th October 2018 and 29th August 2018 respectively are hereby confirmed. However, the condition to attend the Investigating Officer is waived. 6] Both Applications are allowed in the aforesaid terms. (A.S.GADKARI, J.) 2/2
