Learned Counsel appearing for the respondents firstly pointed out that the copy of the letter dated 07/04/2018 annexed at Item No. 8 of the additional compilation of the documents tendered by the petitioner is not a correct copy in the sense that the second page of the letter dated 07/04/20018 has not been annexed and the second page of some other letter has been annexed.

On instructions of Shri Lt. Col. Shri Amit Ranjan Bajpai, Garrison Engineer, Lonawala who is personally present in the Court, the learned Counsel for the respondents states that the impugned communication dated 27/09/2018 (on page Nos. 21 & 27 of the Petition) shall be withdrawn and a show cause notice will be served upon the petitioner in which 15 days' time will be given to the petitioner to respond.

He further states that if the petitioner submits a reply within the stipulated time, after considering the reply, a fresh order shall be passed by the concerned authority. 4.
