The Petitioner was in the employment of the State Government. The Petitioner is raising the service dispute qua the State Government. The Petitioner in fact is relying on the decision of the Maharashtra Administrative Tribunal.

The law is settled by the Constitutional Bench in L. Chandra Kumar vs. Union of India and Others 1 that for the dispute relating to service with the State Authorities, the Court of first instance is the Administrative Tribunal and the High Court should not directly entertain the Writ Petition.
