Heard the learned Advocates appearing for the parties and the following order is passed by consent :

(i) The impugned order dated 13th October, 2017 is set aside. (ii)The learned Member, Industrial Court at Pune shall hear the Application at Exhibit U-2 afresh and pass orders within a period of 8 weeks from the date of this order.

wp 12522 of 2017 (904).sxw (iii)The Advocate and parties shall appear before the learned Member, Industrial Court at Pune on 28th November, 2017 at 11.00 a.m. and after producing a copy of this order obtain necessary directions. (iv)The parties and the Advocates shall not seek any adjournments unless absolutely necessary. The learned Member, Industrial Court at Pune shall not grant adjournments to the parties unless absolutely necessary. (iv)Ad-interim order passed by the Industrial Court shall continue for a period of 8 weeks from the date of this order. (v) All issues including the maintainability of the Complaint are kept open.
