This is an application for relaxation of condition No.2 of the Order dated 16th June 2017 passed by this Court in Bail Application No.1159 of 2017.

Heard the learned Advocate appearing for the applicant/accused. He argued that with passage of time now the charge-sheet has been filed and the case is committed to the Court of Sessions. He further argued that initially, the applicant was working at Mumbai, but now he is transferred to Bangalore and therefore, he is finding it difficult to attend the Police Station as per the directions of this court.

(917)APPPNo.10552017 The learned Additional Public Prosecutor opposed the application by contending that the applicant be directed to attend the Police Station as and when directed by the Investigating Officer.

Undisputedly, the charge-sheet has been filed and the case is committed to the Court of Session. Now the matter is between the Court and the applicant/accused. Therefore, now there is no propriety in continuing the condition No.2 of the Order dated 16th June 2017 directing the applicant to attend the MIDC Police Station, Andheri, Mumbai once in a fortnight on Saturday between 11.00 a.m. to 1.00 p.m. till further Orders. Hence, the Order :

(i) The application is allowed.

(ii) Condition No.2 in the Order dated 16th June 2017 in Bail Application No.1159 of 2017 stands deleted.

(iii) The applicant is directed to attend each and every date of hearing before the learned Additional Sessions Judge at Dindoshi, where reportedly his case is pending, unless exempted by the concerned Court.
