After this petition was heard for some time, learned Counsel for the petitioner seeks leave to withdraw this petition with a liberty to approach the trial Court to seek modification of the interim order for maintenance.

The petition is allowed to be withdrawn with a liberty as prayed for.

Learned Counsel for the respondent at this stage would point out that the trial in the main proceedings has proceeded upto cross examination of the respondent-wife. In the circumstances, the

Pvr 2/2 903wp9122-15-caw1687-3051.doc learned Judge, Family Court, shall endeavour to dispose of the main proceeding as expeditiously as possible and in any event within a period of six months from today.

Needless to observe that the liberty as granted above to the petitioner shall not in any manner affect the hearing of the main proceedings being conducted by the family Court. 5.

As the writ petition stands withdrawn, civil application nos.1687 of 2017 and 3051 of 2016 would also not survive and the same are disposed of, however with a liberty to the petitioner to assert the grievances if any, before the family Court. (G.S.KULKARNI, J.)
