Communication from prisoner shows that his furlough cannot be looked into since police authorities at Patna, Bihar are not sending necessary reports.

Learned APP has invited our attention to communication dated 4/9/2019. It shows that from 5/2/2019 practically every month reminders have been sent by the Superintendent of Nashik Road Prison to Police Superintendent of Patna.

In this situation, we direct the said authority at Patna to expedite the action and to submit necessary report to Superintendent, Nashik Road Prison within 4 weeks after receipt Talwalkar

Superintendent, Nashik Road Prison to communicate this order to concerned authority at Patna, Bihar. We also grant petitioner leave to apply for furlough pointing out some other place in State of Maharashtra where he would always be available during furlough period. If such application is moved, authority is free to consider in accordance with law.
