Heard the learned counsel for the applicant and the learned APP for the State.

The applicant has preferred this application for pre-arrest bail in connection with C.R. No. 48/2019 registered with Bhoiwada Police Station, Mumbai, for the offences punishable under sections 3, Digitally signed by SHRADDHA KAMLESH TALEKAR Date:
2021.08.07 16:00:00 +0530 11 and 13 of Maharashtra Ownership of Flats Act, 1963 and sections SHRADDHA KAMLESH TALEKAR 406, 409, 414, 415, 416, 417, 418, 419, 420, 461, 463, 465, 467 and 471 of the Indian Penal Code, 1860.

The gravamen of indictment against the applicant is that the applicant herein is a Developer of Kinjal Villa. He sold rehab tenement of Kinjal Villa to the first informant Shri Mukesh Javerichand Mehta and others and did not execute the conveyance in favour of the society.

By an order dated 14th November 2019, this Court has granted interim relief.

Today, the Investigating Officer has tendered before the Court report dated 6th August 2018 to the effect that pursuant to the order dated 14th November 2019, the accused came to be arrested in the above-numbered C.R. and was released on bail on 5th January 2021. Subsequently, post completion of investigation, charge-sheet has been lodged against the accused on 11th January 2021 in the Court of the learned Metropolitan Magistrate, 29th Court, Dadar, Mumbai, leading to Case No. 44/PW/2021. When the charge-sheet was filed, the applicant was present and has been ordered to be released on furnishing bail, by the learned Magistrate.

In view of the aforesaid developments, in the intervening period, the learned APP fairly submits that nothing survives in this application.

Since the investigation is complete, charge-sheet has been lodged and the applicant has been ordered to be released on bail, the interim order dated 14th November 2019 granting anticipatory bail to the applicant is made absolute.

The application, thus, stands disposed of.
