Learned counsel appearing for the applicant, on instructions, submits that arrears of Rs.1,12,26,300/- will be deposited in the Small Causes Court, Mumbai in two equal installments on or before 15th December 2023, the first installment will be deposited on or before 10th November 2023 and the second installment will be deposited on or before 15th December 2023. He, on instructions, further submits that arrears of monthly compensation for the period June 2023 to 30th Patil-SR 1 of

29 Ia-16786-2023.doc October 2023 will be deposited in the Small Causes Court, Mumbai by 6th November 2023. The statements made on instructions are accepted as undertakings to this Court.

In view of the above, learned counsel appearing for the respondent submits that execution proceedings will not be proceeded with till the deposit of second installment.

Needless to clarify that in event of default in payment of any of the installments, the stay granted earlier to be vacated automatically without reference to this Court. 4.

Interim application stands disposed of.
