The learned APP submitted that the trial arising out of the present crime i. e. C. R. No. 399 of 2016 registered with Chakan Police Station, Pune (Rural) has already commenced and the evidence of prosecutrix is recorded.

In view thereof, the learned counsel for the Applicant on instructions seeks leave to withdraw the present Application. 3.

As the trial pertaining to the present crime is under the special statute namely the Protection of Children from Sexual Offences Act, it is expected from the learned trial Court to abide by the mandate of law and to expedite the trial.

Application is disposed of as withdrawn.
