Learned counsel for the applicant submits that during the pendency of the present application police have now filed the charge sheet.

In view of the change in circumstance, he seeks leave to withdraw the present application with liberty to file a fresh bail application before the trial court. Leave and liberty is granted. Application is dismissed as withdrawn.

2) The learned trial court is hereby directed to consider the fresh bail application, if filed, on its own merits without being influenced by the order passed by this court.
