1] This is an application under Section 439 of Cr. P.C. for bail in CR No. 28 of 2018 dated 23.5.2018 registered with Mandangad Police Station, District Ratnagiri under Sections 302, 336, 324, 504, 506 read with 34 of Indian Penal Code.

2] Heard the learned Counsel for the applicant and the learned APP. Perused the chargesheet.

3] The allegation against the applicant is that, on the suspicion that her husband Shantaram was having extra marital affair with deceased Rekha Mukna, the applicant along with other five co-accused committed murder of Smt. Rekha Mukna.

BA.2809-2018.doc 4] The record indicates that, other five accused who were similarly situated like the applicant have been granted bail by the Trial Court by its Order dated 10.9.2018. The application of the applicant was rejected on the ground that, the motive revolves around her. Perusal of chargesheet would indicate that, the co-accused namely Shobha Mukna, Chandri Mukna, Yogita Jadhav, Vatsala Jadhav and Bhagi Mukna have played same and/or similar role in the present crime who have been granted bail. In view thereof, the applicant is entitled to be released on bail. Hence the following Order:- i] Applicant be released on bail in CR No. 28 of 2018 registered with Mandangad Police Station, District Ratnagiri, on her furnishing PR bond of Rs.15,000/- with one or two local sureties in the like amount. ii] After her release from jail, the Applicant shall not entered into village Dahimbe, Aadiwasiwadi, Taluka Mandangad, District Rarnagiri till the conclusion of trial.

iii] Applicant shall also attend all the dates before the Trial Court. 5] Application is allowed in the aforesaid terms. (A.S.GADKARI, J.) 2/2
