Submission is petitioner No. 3 was not in India on alleged date i.e. 2/6/2018. Support is being taken from some documents to show that he had come back to country only in 2016.

Learned APP submits that police is investigating into the matter and if this grievance is made with proper documents, investigating officer will look into it.

In view of the statement made by the learned APP, we permit the petitioners to submit necessary documents showing his non-availability in country on 2/6/2018 or whereabouts. The petitioner is currently out of India. He can Talwalkar
