This is an application under Section 438 of Cr.P.C. filed by the aforesaid applicant apprehending his arrest in C.R.No.435 of 2022 registered with Phaltan Police Station for offences punishable under Sections 420,467, 468, 471 and 472 r/w. 34 of IPC. 2.
Heard Ms.Vrushali Maindad, learned counsel for the applicant and Mr. A.A.Palkar learned APP for the State. I have perused the records and considered the submissions advanced by the learned counsel for the respective parties. 1/6

The crime against the applicant was registered pursuant to the FIR dated 02/09/2022, lodged by one Nitish Popatrao Bhosale. The complainant has alleged that in the year September, 2017 the co-accused Maruti Mohite informed him that there were some vacancies in GST Office and that he could provide a job for him. He told the complainant to keep all the documents ready. The Accused No.1 took all the relevant documents from the complainant and called him to the house of Ravi A. Wanve. The complainant has stated that he went to the house of the applicant no.1 and handed over the documents to the accused No.1 and 2. The complainant was assured that he would be appointed on the post of GST Assistant. The complainant was sent to Four Point Hotel with original documents for verification.
About 40-50 other candidates had also come for document verification as self attested. He has stated that the applicant Chandrajeet Patil and other co-accused were present in the said Hotel. All the candidates were instructed to deposit their mobiles, watches, and belts at the counter. After verification they were shown some order and an amount of Rs.25,000/- was taken from each of the candidates.

The complainant has alleged that the accused No. 1 and 2 kept assuring him that he would be getting a joining letter. About 10 days before 07/1/2019, he received one training order by post which indicated that training was scheduled on 07/01/2019 at National Institute of Finance Management, Delhi, Faridabad. The complainant was asked to pay additional amount of Rs.30,000/- towards training fees and was told to come alongwith money/cheque at Four Point Hotel, Vashi. The complainant has stated that he borrowed an amount of Rs.30,000/- from his uncle and went to Four point Hotel at Vashi. About 40-50 candidates were present, they were given one brown paper envelope and that the applicant had told each of them to put Rs.30,000/- in the said envelope and hand over the envelope to accused No.1 and 2.
Complainant has stated that accordingly they put Rs.30,000/- in an envelope and gave the same to accused Nos.1 and 2. He has further stated that their signatures were obtained on some blank papers alongwith two blank cheques. They were informed that the training would be for a period of 30 days. Subsequently, accused No.
for training in the next batch and not to book the Train ticket. 5.
Accused No.1 and 2 once again called him and others to Maljai Temple. Initially, they were told to pay an amount of Rs.2,00,000/-. The complainant has stated that he sold the Mangalsutra of his Mother and paid the amount to the accused No.1 and 2. In the month of April 2019, accused No.1 and 2 told him that training was scheduled at Abhinav Education Society Ambegaon, Pune. He alongwith others were imparted training for a period of 30 days. During the course of the training, the coaccused Nitin Chaturvedi and Sachin Chaturvedi, took Rs.20,000/- from each of them with 2 Stamp papers of Rs.500/- and Rs.100/- each, stating that the same were needed for preparing service bond.

About 4 to 5 days later they were once again called to Four Point Hotel at Vashi, their signatures were obtained on the Stamp paper. They were later asked to obtain medical fitness certificate and thereafter were taken to CII Delhi,(Confederation of 4/6
Indian Industries) and were made to pay Rs.15,500/- each. They were later told that there was delay in issuing Joining letter because of outbreak of Covid-19 Pandemic. The co-accused thereafter avoided to give basic answers. He has stated, on 29/3/2019 the applicant took a Zoom meeting and informed them that they were nominated and would be soon getting joining letters. The complainant and others did not receive any such letter and learnt that he and others were cheated. Hence, the FIR against the applicant and the other co-accused. 7.
The statement of some of the candidates have been recorded. These witnesses have also prima facie corroborated the facts narrated in the FIR and have implicated the applicant in the said crime. The material on record prima facie indicates that several unemployed youths were given false assurance of employment. They were given false and fabricated training orders and were also imparted training. The records prima facie show the involvement of the applicant in the commission of said crime. The offence needs to be investigated thoroughly. Considering the above 5/6
facts and circumstances, I am not inclined to grant anticipatory bail. Hence application is dismissed.
