Learned APP at the outset makes statement that though chargesheet in the C.R.No.72 of 2014 is filed before the concerned Magistrate, petitioner is not shown as accused. Further investigation is being carried out under Section 173(8) of the Code of Criminal Procedure into said C.R.

In view of the above statement, learned counsel for petitioner seeks leave to withdraw the petition with liberty to approach this Court after filing of the report under Section 173(8) of the Code of Criminal Procedure.

Petition is dismissed as withdrawn.

We direct the Senior Inspector of Police, Unit-I, E.O.W. Crime Branch C.I.D. Mumbai, to complete further investigation of the said C.R. expeditiously.
