This is an application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The applicant came to be arrested in Crime No. 157 of 2022 registered at Daund Police Station, for the offence punishable under Sections 302, 201, 120-B r/w. 34 of Indian Penal Code. 3.
The deceased was the husband of the present applicant. According to the prosecution, the present applicant had illicit relations with co-accused. It is alleged that the present applicant alongwith coaccused thus committed the murder of deceased. Kanchan P Dhuri 1 / 2

I have heard the learned Counsel for the applicant and the learned APP for the State.

The learned Counsel for the applicant has pointed out the statement of Dnayneshwar Ganpat Shinde. It appears from his statement that on 14 March 2022, the present applicant had left the house of the deceased and went to her parents house, and the alleged incident thereafter took place on 25 March 2022. The allegations against the applicant are of conspiracy only. Considering these facts, I am inclined to release the applicant on bail. Hence, the following order is passed : (i) Application is allowed.
(ii) The applicant - Ashwini Rajendra Shinde be released on bail in Crime No. 157 of 2022 registered at Daund Police Station, for the offence punishable under Sections 302, 201, 120-B r/w. 34 of Indian Penal Code on furnishing P.R. Bond in the sum of Rs.15,000/- with one surety in the like amount.
