The learned counsel for the applicants-accused seeks liberty to withdraw this application as the applicants want to exhaust the remedy of filing the Bail Application before the Sessions Court, as their Bail Application No. 1439 of 2016 was disposed of for want of prosecution by the learned I/c. Additional Sessions Judge-5, Nashik on 17th December 2016. He submits that the present Anticipatory Bail Application before this Court was filed for challenging the order dated
Trupti 901-ABA-2070 -2016-CR.APP-1044-2016 24th November 2016 rejecting interim bail in the said matter. However, interregnum, the bail application was disposed of without hearing. The applicants may file application for the restoration before the learned Sessions Judge at Nashik. Liberty is granted. 2.
