The applicant apprehending his arrest in Crime No.329 of 2015 registered by Dadar Police Station has sought anticipatory bail.
From the record made available by the the learned Additional Public Prosecutor, it appears that one Anita Koli at the instance co-accused Madhavi-sister of applicant has deposited amount of Rs.3,00,000/- in the ICICI bank account of applicant. From the police report filed before the learned trial Court it reveals that material allegations are against co-accused Madhavi. It appears that this Court by its order dated 02/12/2015 Gaikwad RD 1/2
(5)ABANo.18262015 had granted interim protection to applicant on his giving undertaking to deposit Rs.3,00,000/- with the registry of this Court within one week from the date of order. The learned counsel for the applicant makes a statement that applicant, in pursuance to undertaking, had deposited Rs.3,00,000/- in this Court on 16/12/2015.
The learned counsel for the applicant has also contended that initially the application was opposed by prosecution as principal accused Madhavi was absconding. The learned Additional Public Prosecutor, on instructions, makes statement that said accused is arrested.
In that view of the matter, interim protection granted to applicant is liable to be confirmed on the same terms and conditions, except for cancelling earlier condition and modifying the same directing applicant to mark his presence with Investigating Officer as and when called between 6.30 p.m. to 8.30 p.m, till filing of charge-sheet.
In above terms, application is allowed.
