After arguing the matter for some time, learned counsel for the petitioner on instructions seeks leave to withdraw the writ petition with liberty to challenge the impugned order at a later stage in the event the reference is decided against the petitioner.

Keeping this liberty open, the writ petition is allowed to be withdrawn and disposed of accordingly.

Needless to mention that the observations made in the impugned order by the Labour Court are obviously limited for deciding the application below Exhibit C-33 which is open to challenge at an appropriate stage. The observations made therein will not influence the decision in the main matter.
