The applicant/accused is seeking relaxation of condition No.2 of the order dated 16th June 2017 passed in bail application No. 1272 of 2017 by this Court.

Heard the learned advocate appearing for the applicant/accused.

He submit that the applicant is adhering to the condition no.2 scrupulously, but now, as he wants to join his employer on M.V. Columbus Vessel, the said condition may be relaxed. The learned advocate upon being asked submit that as yet even the charge-sheet is not filed against him. 4.

The learned APP opposed the application by contending that the condition is necessary and it may not be relaxed. 5.

I have carefully considered the rival submissions and also perused the material placed on record. It is seen that even the employer of the present applicant has enquired into the incident which allegedly happened on high sea in the Vessel and concluded that there are several incidents of complaints lodged by the prosecutrix of similar nature in the past. That is how the applicant was granted bail with other considerations also. Now the applicant is desires of attending his job on the Vessel and therefore, I see no reason to Kavita Page 2 of 3

continue condition no.2 imposed on the present applicant, while releasing him on bail. Therefore the order.

ORDER

Condition no.2 in the order dated 16th June 2017 passed on bail application no.1272 of 2017 stands deleted. (A.M. BADAR, J ) Kavita Page 3 of 3
