Heard Mr. R.D.Chheda, learned counsel for the petitioner and Mr A.R.Patil, learned A.P.P for respondent no.1-State. 2.

Mr. Chheda states that he will take out appropriate proceedings before appropriate forum claiming the reliefs claimed in this application. He further submits that the Criminal Appeal preferred by the petitioner may be fixed peremptorily for final hearing.

In view thereof, the Criminal Application is allowed to be withdrawn with liberty as prayed for.
