Perused the record and the progress report furnished by the learned A.P.P. signed by the Investigating Officer and counter signed by the Police Inspector, Police Station Vita, Thane.

It is submitted that the investigation is almost complete. It reveals from the report that the I.O. could not collect sufficient material against both the Bank Managers namely Ramesh Hemade and Jayant Wagh. The crime was registered on 03.09.2019. It has been almost 2 years that the investigation could not be brought to its logical end. It is surprising as to how Shrikant Suresh Gonjari who was appointed as a 'Sweeper', had been entrusted with responsible work of carrying the golden ornaments to the Valuer for verification.

It is submitted by the learned Counsel for the applicant Mr.Mankapure that the applicant has been cooperating with the investigating agency. It appears that the main accused Shrikant Suresh Gonjari has already been released on bail. Applicant Snehal Shrikant Gonjari is his wife and applicant Santosh Vilas Gonajri is his brother. It appears that the I.O. does not require custodial interrogation of the applicants.

As such, the interim relief granted by this Court to the applicants, by an order dated 19.11.2019 is confirmed. However, the applicants shall not in any manner influence any of the prosecution witnesses and shall not leave the jurisdiction of the concerned Court without seeking prior permission.
