This application for bail has been moved as the applicant/accused alongwith the co-accused is facing charges under sections 420, 327, 395 r/w 34 of the Indian Penal Code. The learned Counsel for the applicant/accused submits that the applicant/accused has a very good case on merits and the applicant/accused is behind bars since 2014. The learned Prosecutor informs the Court that the charge is already framed and six witnesses are examined. He submits that the case is in the midst of the trial and under such circumstances, this application is not to be considered. He further submits that 10 to 12 witnesses are to be examined.

Without going into the merits of the matter, considering the stage of the trial, in my view, it is not proper to decide the bail application at this stage as evidence is being placed before the trial Court. Accordingly, the application is rejected. However, the trial Court is requested to complete the trial on or before 15.8.2015. In the event the trial is not completed,the applicant/accused is given liberty to file a bail application before this Court. 3.
The application stands disposed of.
