By this civil application, the applicant seeks condonation of delay of 42 days, wrongly mentioned in the civil application as 427 days, in filing the second appeal. The applicant had filed review application against the impugned order before the lower appellate Court which was disposed of on 11th November, 2014. The applicant thereafter filed this civil application and in this process there was delay of 42 days.

There is no affidavit in reply filed to the civil application. The learned A.G.P. has no objection if the delay of 42 days is 1/2

7-cas404-15 condoned. For the reasons recorded in the civil application, the delay of 42 days in filing the second appeal is condoned. If there are any office objections, the same shall be removed within two weeks from today.

The civil application is accordingly disposed of in aforesaid terms. No order as to costs.
