Heard learned counsel for the Applicant and the learned counsel for the Respondent.

The learned counsel for the Applicant submit that the Applicant has filed Marriage Petition before the Family Court seeking divorce whereas the Respondent has filed Application under Protection of Women from Domestic Violence Act, 2005 which is pending before the Metropolitan Magistrate, Mulund, Mumbai. Hence, both these matters be clubbed together at Family Court, Bandra.

The learned counsel for the Respondent has objected to transfer of the matter from Metropolitan Magistrate, Mulund to Family Court, Bandra on the ground that the D.V. application is kept for argument and if the said Application is transferred at Bandra it would be prolonged.

The learned counsel further submit that if the proceedings under D.V. Act is expedited after transfer at Family Court at Bandra, then he has no objection for clubbing these two matters together.

Considering the submissions of both the counsel the Application is allowed in terms of prayer clause (a) and (b). 6.

The learned Family Court is requested to expedite the hearing of the D.V. Application if possible, preferably within three month.
