This is an application for bail in CR No. 24 of 2018 registered with Powai Police Station for the offences punishable under Sections 354(A)(B) of Indian Penal Code alongwith Sections 8 and 12 of POCSO Act. FIR was registered on 11st January, 2017. 2.

The case of the prosecution is that victim child was subjected to act of outraging modesty by the applicant. Applicant was arrested on 11th January, 2018. It is pointed out from the medical report which are annexed to this application that the applicant is suffering from HIV and he is undergoing treatement for the same. Investigation is completed and chargesheet has been filed. Applicant can be released on bail on certain terms and conditions.

ORDER

i Criminal Bail Application is allowed;

ii.

Applicant is directed to be released on bail in connection with C.R. No. 24 of 2018 registered with Powai Police Station on furnishing P.R. Bond in the sum of Rs. 25,000/- with one or more sureties in the like amount;

iii.

Applicant shall not enter within the jurisdiction of Powai Police Station and shall not temper with the prosecution witnesses or pressurize the witnesses;

iv.

Applicant shall attend the trial Court on the date of hearing unless exempted by the trial Court;

v.

Applicant shall furnish details of his residential address to the Investigating Officer after he is released on bail; v.
