This is an application for early hearing of the appeal challenging conviction of the applicant/accused for offences punishable under Sections 7, 13(2) read with Section 13(1)(d) of the Prevention of Corruption Act, 1988.

Heard the learned Advocate appearing for the applicant/accused. He argued that on earlier occasions, this Court has expedited hearing of the appeal. The same is not listed for final hearing. The applicant/accused is terminated from service after his conviction and he is suffering financially as well as psychologically.

(24)APPANo.15572017 The applicant/accused is undisputedly on bail. Several jail appeals in which appellants are literally undergone substantive sentence for 8, 9 or 10 years are already on board of final hearing of this Court.

In this view of the matter, in view of the Judgment of the Honourable Apex Court in the matter of Hussain & Anr. v. Union of India reported in 2017 (5) SCC 702, the application cannot be allowed. The same is, therefore, rejected. (A.M.BADAR J.) Gaikwad RD 2/2
