Heard. This Application is made by the legal heirs for bringing them on record in the Contempt Petition as the sole Petitioner Shivaji Narhari Kavde expired on 06.10.2017. The Civil Application is made on 15.11.2015 i.e. within limitation.

Considering the submissions made by the learned counsel for the Applicant, the averments made in the Application and since the Civil Application made is within limitation, we are satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:

a) The Applicant is permitted to carry out amendment in the Contempt Petition for bringing the legal heirs on record of the deceased sole Petitioner Shivaji Narhari Kavde b) Amendment to be carried out within four weeks from today, failing which the Civil Application shall stand dismissed without further reference to the court.

c) If amendment is carried out within stipulated time as stated hereinabove, the Applicant is directed to serve an amended copy of the Contempt Petition, on the Advocate for the Respondents and/or Respondent, immediately thereafter.

d) Civil application stands disposed off accordingly.
