IN THE HIGH COURT OF JUDICATURE AT BOMBAY CRIMINAL APPELLATE JURISDICTION CRIMINAL APPLICATION No. 786 OF 2015 [for condonation of delay] IN CRIMINAL APPLICATION No. OF .

[For leave to appeal] The State of Maharashtra.

..Applicant.

Versus

Lata Rambhahadur Thapa.

..Respondent.

Ms. S. D. Shinde, APP for the Applicant - State. Coram : Ranjit More & M. S. Karnik, JJ.

Date : February 3, 2017.

P. C. :

1.

Heard learned APP for the State. None appears for the Respondent though served.

2.

Application is filed for condonation of 157 days delay occurred in filing application for leave to appeal. The Applicant has given explanation for delay by making averments in paragraph 2 to 6. The explanation, in our opinion, is satisfactory. Even otherwise, the Respondent is deemed to have accepted those averments as despite service none appears on her behalf. In that view of the matter, we allow this application in terms of prayer clause (b). Registry to number the application for leave to appeal and place it before the Court as per its turn. This application stands disposed of.
