Challenge in this writ petition is to the order dated 2 September 2023 granting conditional leave to defend on deposit of Rs.44,46,333/- within two months from the date of order. 2.

Considering admission by the defendant about the suit claim, no interference on merits in the judgment is called for. 3.

However, considering prayer made by the Advocate for the petitioner to extend time to deposit the amount, the period to deposit amount is extended by a period of four months from today. 4.

The writ petition stands disposed of in above terms. No costs.
