At the outset, learned APP on the instructions of the investigating officer, Mr. Thakur, API, who is present in Court submits that the trial has commenced and till date, three witnesses have been examined. She submits that 5-6 more witnesses are yet to be examined.

In view of the statement made by the learned APP, learned counsel for the Applicant seeks leave to withdraw this Application. He, however, requests that the trial be expedited and be made time bound.

Learned APP on instructions submits that the prosecution will keep their witnesses available and present before the trial Court on the dates given by the trial Court. Statement accepted.

Accordingly, the Application is disposed of as withdrawn. The trial of the Applicant is expedited. Since the trial has commenced, the learned Sessions Judge to conclude the case as expeditiously as possible and in any event within nine months from the date of receipt of this order.
