This Application is moved by the applicant/wife for restoration of Miscellaneous Civil Application, which was dismissed by the conditional order dated 10th April, 2017 passed by the Registrar (Judicial-II).

The learned counsel for the applicant submitted that this Court by order dated 15th February, 2017 has issued notice to the respondent, however, for furnishing the copies of appeal memo, conditional order of dismissal was passed on 10th April, 2017 by Registrar (Judicial-II). For want of compliance, the Miscellaneous Civil Application was dismissed. He submitted that the applicant is ready to comply with the order and prays that Miscellaneous Civil 1 / 2

24.CAO346_2017.doc Application be restored. He further prays that delay of 197 days in filing this Civil Application may be condoned. 3.

In view of the submissions made by the learned counsel and as the Miscellaneous Civil Application was dismissed before issuance of notice, the order dated 10th April, 2017 is hereby recalled. Delay is condoned. Miscellaneous Civil Application is restored to its original file. The copies of the appeal memo is to be furnished to the registry on or before 25th April, 2018 and thereafter the notice is to be issued to the respondent.
