The learned Counsel for the Petitioner submits that in the present case, the trial in C.C. No. 617 of 2011 is concluded. The accused are acquitted of all the charges. Hence, the prayers in the present Petition have become infructuous. The learned Counsel for the Petitioner upon instructions therefore, seeks liberty to withdraw the Petition. Liberty as prayed for is granted in the interest of justice. The Writ Petition stands dismissed as withdrawn. However, the Petitioner is at liberty to challenge the operative order passed in Cr. Talwalkar 1/2
48.wp4252.12.sxw Case No. 617 of 2011 and the same shall be decided in accordance with law.
