This is an application for bail in connection with C.R.No.I-31 of 2014, registered with Vangaon Police Station, Taluka-Dahanu, District Palghar, for the offences punishable under Sections 302 and 201 read with 34 of Indian Penal Code ("IPC", for short). Learned counsel for the applicant submits that the applicant is in custody for more than four years. The role attributed to the applicant is that he has assaulted by stick. It is submitted that the co-accused has been granted bail by this Court vide order dated 4th October, 2018. Learned APP, however,

rpa 2/2 915-ba-2838-18.doc submitted that the trial has already proceeded. Except the investigating officer, all other witnesses are examined. The next date before the trial Court is 18th December, 2018. Taking into consideration the fact that trial is at the concluding stage and one witness is to be examined, I am not inclined to grant bail. The trial Court shall proceed with the matter and since only one witness is remained be examined, trial to be concluded expeditiously. Hence, Bail Application No.2838 of 2018, is rejected.
