The learned counsel appearing for the petitioner seeks time.
The challenge in this Petition under Article 226 of the Constitution of India is to the notice dated 15 th May, 2015 issued by the Urban Development Department of the State Government. By the said notice, proposed modification to regional plan which came into force on th September, 1992 has been notified and objections and suggestions have been invited.
wp12315.15.odt As of today, amendment to the sanctioned regional plan has not been approved. If the petitioner has filed objections, the Appropriate Authority is bound to consider the said objections in accordance with law. Therefore, the challenge to notification dated 15 th May, 2015 need not be entertained. If proposed modification is approved, the petitioner can always challenge the same in accordance with law.
