Learned counsel for the applicant at the out set submitted that taking into consideration the concurrent jurisdiction of this court and the Sessions Court the applicant has preferred this application directly to this court. Judicial propriety demands that the applicant shall first approach and file the appropriate proceeding before the trial court. In view of the above, the learned counsel for the applicant seeks leave to withdraw the application with a view to file appropriate proceeding before the trial court.
