The Petitioner, a father-in-law, during argument, fairly discloses that the application for discharge moved by his wife (mother-in-law of the deceased) is rejected by the trial Court and challenge thereto is pending before the learned Single Judge of this Court. The learned Single Judge has stayed the proceedings before the trial Court.

In this situation, we are not inclined to intervene in extraordinary jurisdiction.

With liberty to the Petitioner to follow the same course, we dispose of the present petition.
