The order impugned is passed by Maharashtra Revenue Tribunal ('MRT' for short) refusing to condone the delay as no sufficient cause is cited.

Heard the learned counsel for the petitioner and the learned counsel for respondent.

2 38.1507.17 wp.doc There is delay of 61 days in preferring Revision before MRT. Amongst other reasons cited were, present matter before Collector and the lawyer was under impression that the Tribunal has summer vacation.

Considering the length of delay and the cause cited, subject to payment of cost of Rs. 3000/- to be deposited in the MRT, delay stands condoned. Respondent will be entitled for the cost. Cost to be deposited within period of 4 weeks from today. Petition stands disposed of.

This Court expects MRT to decide the Revision expeditiously. Parties hereto agree that they shall appear before MRT on 01/07/2019. As such, notices to respective parties are dispensed with.
