Heard learned Counsel for the parties.

Complainant and his companions are working in one department, alleged that in October, 2011 and

2/3 BA-3188-2019 (SR.907) thereafter, they in all together paid Rs.11,00,000/- to the applicant and co-accused, Janardhan, who had promised them allotment of tenaments (Rooms) in a building from the reserved quota, of the State. The complaint was lodged in March, 2015 and the applicant was apprehended on 1st October, 2019. Investigation is complete.

Documentary evidence shows, the complainant and his companions, paid Rs.11,00,000/- to the co-accused partly in cash and cheque. Receipt, of cash (acknowledgment) is witnessed by the applicant. It is alleged that, this applicant had introduced the co-accused to the complainant and his companions. Prima-facie evidence suggest, Rs.11,00,000/- were received by the co-accused. No overt act is attributed to the applicant. Since investigation is over, applicants custody is not warranted. In '

view of the accusation, applicant is directed to be released on bail in C.R. No. 113 of 2015 registered with Malad Police Station, on furnishing P.R. Bond of Rs.25,000/- (Rs. Twenty Five Thousand only) with one or two sureties in the like amount.

3/3 BA-3188-2019 (SR.907) (iii) The applicant shall attend the concerned Police Station as and when called.

(iv) The applicant shall furnish the particulars of his place of residence and mobile number to the Investigating Officer of the Police Station concerned within seven days from his release on bail.

(v) The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.
