P.C.:- 1) By a reasoned order dated 12th December, 2017, the applicant was granted interim relief and was directed to attend the Investigating Officer on stipulated dates to join the process of investigation. 2) Heard the learned counsel for the applicant, the learned counsel for the first informant and the learned APP for the State. Perused the record of investigation.
3) The record indicates that the applicant has given his specimen signature and thumb impression to the Investigating Officer and the report from the Handwriting Expert is awaited. As the applicant has cooperated in the process of investigation, in the opinion of this Court, his custodial interrogation in the present crime is not necessary. 1/2
Ladda 914-aba-2014-17.doc 4) In view of thereof, interim relief granted by an order dated 12th December, 2017 is hereby confirmed. However, the condition to attend the Investigating Officer is waived.
The application is allowed in the aforestated terms. 5) In view of order passed in ABA No. 2014 of 2017, Criminal Application No.917 of 2018 does not survive and is accordingly disposed of.
