Heard. This is an application under Section 438 of Cr.P.C. The applicant herein is apprehending her arrest in Crime No.508 of 2016 registered at Hinjewadi Police Station on 25.10.2016 for the offences punishable under Sections 406, 420 read with Section 34 of the Indian Penal Code.

After arguing for some time, the learned counsel for the applicant submits that he would withdraw the application with liberty. Liberty as prayed for is granted in the interest of justice with further liberty

Mhi 2 ABA-2078-16.sxw to the applicant to appear before the concerned Magistrate on or before 9.12.2016. The learned Magistrate shall consider the application of the present applicant under Section 437 of Cr.P.C. without being influenced by the withdrawal of the present applicant. The learned Magistrate shall make an endeavour to decide the application on the same day when the applicant appears before the Court.

In view of this, the applicant stands protected till 5 p.m. on 9.12.2016.
