Heard learned counsel for the parties.

Respondent No.2 - Prakash Tambe has filed an Affidavit stating therein that the matter has been amicably resolved between him

and the Applicants and that he intends to withdraw Criminal Complaint, being C.C.No.79/SW/2013 filed by him against the Applicants in the Court of the learned Metropolitan Magistrate, 27th Court, Mulund, Mumbai. The said Affidavit is taken on record and marked as "X" for identification. The Respondent No.2 to comply with para 4 of the Affidavit and to take steps to withdraw Criminal Complaint, being C.C.No.79/SW/2013 which is pending before the learned Metropolitan Magistrate, 27th Court, Mulund, Mumbai.

In view of the Affidavit filed by the Respondent No.2, the Applicants do not press the aforesaid Application as well as the Writ Petition and seek leave to withdraw the same. Accordingly, the aforesaid Cri. Application and Cri. Writ Petition are disposed of as withdrawn.

Parties to act on the authenticated copy of this order.
