" That this Hon'ble Court may pass appropriate orders and quash and set aside the FIR bearing MCR No.05 of 2009 registered with MHB Police Station, Borivali and proceedings pending before the ld. 68 Metropolitan Magistrate, Borivali Court vide Case No.1095/PW/2010 for offences punishable U/s. 409, 420 r/w. 34 of IPC as against the Petitioners."

It is not disputed that charge is already framed. The petitioner, therefore, has an alternative and efficacious remedy to challenge the order of framing charge by filing appropriate revision before the Sessions Court.
