The petitioner filed a complaint dated 13/7/2011 with Mumbra Police Station, which was registered as FIR No. I-0333 of 2011 (Exhibit "A"). The grievance of the petitioner is that for last five years the Investigating Officer deliberately delayed the investigation. 2.

An affidavit-in-reply has been filed by Sachin Ashok Patil, Deputy Commissioner of Police, Zone-I, Thane City, District Thane on 8/1/2016. The deponent therein submitted that investigating agency was awaiting handwriting expert's report.

Learned APP, on instructions from PI S. A. Bagwan, Mumbra Police Station, submits that handwriting expert's report has now been received. The investigating agency has decided to file "B" Summary. 4.

We direct the investigating agency to file appropriate report within a week's time before the concerned Magistrate. The learned Magistrate will deal with the report in accordance with law. 5.

The next grievance of the petitioner is that higher authority shall inquire into the reasons for delay in investigation. The learned APP submits that Deputy Commissioner of Police had already conducted an inquiry and submitted report to the concerned Commissioner of Police. The issue is being looked into departmentally. 6.

In view of the aforesaid statements made by the learned APP, petition is disposed of.
