Heard the learned counsel for the applicant and the learned APP for the State.

The learned counsel for the applicant submits that the learned Additional Session Judge has now posted the matter for hearing on 1st November, 2023. On 26th October, 2023 the investigating officer had not filed report.

The learned APP, on instruction of the officer who is present in the Court states that the investigating officer would file reply in the Court of Session on 1st November, 2023. In the meanwhile, till the decision of the application filed before the Court of Session, the applicant would not arrested.
