He submits that it remained on their part to file private paper book immediately. In support of this contention, he relies on letter dated 22.06.2017 Exhibit B to the Civil Application.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the Civil Application. Hence, following order:

First Appeal No.268 of 2000 is restored on file for hearing on its own merits.

b.

Applicant to file private paper book on or before 02.05.2019, failing which First Appeal shall stand dismissed without referring back to the court.

c.

Civil Application stands disposed of accordingly.

d.

No order as to costs.
